Terms of Service

These Terms of Service (“Terms”) govern your use of the ChargeScoutmobile application and this website (together, the “Service”), operated by ChargeScout (“we,” “us,” or “our”). By downloading, accessing, or using the Service, you agree to be bound by these Terms. If you do not agree, do not use the Service.

1. Eligibility

You must be at least 13 years old (or the age of digital consent in your country) to use the Service. By using ChargeScout, you represent that you meet this requirement and that you will comply with these Terms and all applicable laws.

2. The Service

ChargeScout helps you discover and rank electric-vehicle charging stations based on factors such as distance, charging speed, availability, price, and connector compatibility. It also offers an AI charging assistant, trip planning with charging stops, driver reviews, and reliability check-ins. We may add, change, or remove features at any time.

3. Accounts

You can use ChargeScout with an anonymous account or sign in with Apple. You are responsible for activity that occurs under your account and for keeping your device and credentials secure. Notify us promptly of any unauthorized use.

4. Subscriptions and payments

ChargeScout offers a free tier and an optional paid subscription, ChargeScout Pro, available as a monthly ($2.99/month) or annual ($29.99/year) auto-renewable subscription, which may include a free trial.

  • Payment is charged to your Apple ID at confirmation of purchase.
  • Subscriptions automatically renew unless auto-renew is turned off at least 24 hours before the end of the current period.
  • Your account is charged for renewal within 24 hours prior to the end of the current period.
  • You can manage or cancel your subscription anytime in your App Store settings. Deleting the app does not cancel your subscription.
  • If you start a free trial and do not cancel before it ends, it will convert to a paid subscription. Any unused portion of a free trial is forfeited when you purchase a subscription.

Purchases are also subject to Apple’s Standard End User License Agreement (EULA), which applies in addition to these Terms.

5. User content

The Service lets you submit ratings, written reviews, photos, and reliability check-ins (“User Content”). You retain ownership of your User Content. By submitting it, you grant us a worldwide, non-exclusive, royalty-free license to host, store, display, reproduce, and distribute that content within the Service (shown anonymously) to operate and promote the Service.

You agree that your User Content will not:

  • be false, misleading, or fraudulent;
  • infringe anyone’s intellectual property, privacy, or other rights;
  • be unlawful, defamatory, harassing, hateful, or obscene; or
  • contain spam, malware, or unauthorized advertising.

We may remove User Content that violates these Terms and operate a community flagging system. We are not obligated to monitor User Content but may do so.

6. Acceptable use

You agree not to:

  • use the Service while driving in a manner that is unsafe or violates the law — always follow local laws and pay attention to the road;
  • scrape, harvest, or bulk-export data from the Service except as permitted by the underlying data licenses;
  • reverse engineer, interfere with, or attempt to gain unauthorized access to the Service; or
  • use the Service to violate any law or the rights of others.

7. Charging data and accuracy

Charging station information is drawn from OpenStreetMap contributors (available under the Open Database License, ODbL) and from community contributions. Charger availability, pricing, power, hours, and reliability can change without notice and may be incomplete or inaccurate. ChargeScout’s rankings, AI recommendations, and trip estimates are provided for convenience only — always verify critical details, and never rely solely on the app for whether you can reach a destination.

8. Intellectual property

The Service, including its software, design, logos, and content (excluding User Content and third-party data), is owned by us or our licensors and is protected by intellectual property laws. We grant you a limited, personal, non-transferable, revocable license to use the Service for its intended purpose. OpenStreetMap data remains subject to the ODbL.

9. Third-party services

The Service may link to or integrate third-party services (such as Apple Maps, Google Maps, the Apple App Store, and map data providers). We are not responsible for third-party services, and your use of them is governed by their own terms and policies.

10. Disclaimers

THE SERVICE IS PROVIDED “AS IS” AND “AS AVAILABLE” WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS OR IMPLIED, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, ERROR-FREE, OR THAT CHARGING INFORMATION WILL BE ACCURATE OR COMPLETE.

11. Limitation of liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, CHARGESCOUT AND ITS SUPPLIERS WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS, DATA, OR GOODWILL, ARISING FROM OR RELATED TO YOUR USE OF THE SERVICE. OUR TOTAL LIABILITY FOR ANY CLAIM WILL NOT EXCEED THE GREATER OF THE AMOUNT YOU PAID US IN THE 12 MONTHS BEFORE THE CLAIM OR USD $50.

12. Indemnification

You agree to indemnify and hold harmless ChargeScout from any claims, damages, liabilities, and expenses arising out of your User Content, your use of the Service, or your violation of these Terms or applicable law.

13. Termination

We may suspend or terminate your access to the Service at any time if you violate these Terms or to protect the Service and its users. You may stop using the Service at any time. Sections that by their nature should survive termination (including ownership, disclaimers, and limitation of liability) will survive.

14. Governing law & disputes

These Terms are governed by the laws of the United States and the state in which we operate, without regard to conflict-of-law rules. You agree that any disputes will be resolved in the courts located there, unless applicable law requires otherwise.

15. Changes to these Terms

We may update these Terms from time to time. When we make material changes, we will update the “Last updated” date and may provide additional notice. Your continued use of the Service after changes take effect constitutes acceptance of the revised Terms.
